Acceptable Use Policy
Last updated:
This Acceptable Use Policy (our “AUP”) applies to anyone who uses MakePlay and its related products and services (the “Services”), provided by Makeplay AI, Inc., a Delaware corporation (“we”, “us”, “our”). It sets out the standards of behavior we expect from everyone who creates, publishes, plays, or otherwise interacts on MakePlay, and is intended to help our users stay safe and to keep our community healthy. This AUP is incorporated into, and forms part of, our Consumer Terms of Service and any other applicable terms of service; capitalized terms used but not defined in this AUP have the meaning given in the applicable agreement. In the event of a conflict between this AUP and the Consumer Terms of Service with respect to the subject matter of this AUP, this AUP controls.
I. Scope and Application
1. Who this applies to: This AUP applies to everyone who accesses or uses the Services, whether or not they have registered an account, including creators, players, and visitors.
2. What this applies to: This AUP applies to everything you do on or through the Services, including: the prompts and other inputs you submit; the content generated for you; the games, characters, art, audio, code, and other assets you create, upload, publish, or remix; game titles, descriptions, tags, cover images, and thumbnails; your account name, display name, avatar, and profile; and any message, comment, review, report, or other communication you send through the Services.
3. Where this applies: This AUP applies across the MakePlay website and applications, the arcade and any other publishing, discovery, or ranking surface, our support channels, and any official MakePlay community that we operate or designate (including our Discord and Reddit communities). Conduct occurring outside the Services may also be taken into account where it is directed at MakePlay, our users, or our personnel, or where it credibly indicates a risk to them.
4. Private creation is still covered: Content described in Section III (Prohibited Content and Conduct) or Section V (Protecting Minors) is prohibited even where it is never published, shared, or made visible to any other user.
5. Other rules also apply: You must also comply with all applicable laws and with any additional in-product rules, community guidelines, or feature-specific terms we publish. Where applicable law or an in-product rule is stricter than this AUP, the stricter rule applies to you.
II. Core Rules
Five rules underlie everything in this AUP. The sections that follow give examples, but those examples are illustrative and not exhaustive. Conduct that breaches these Core Rules may be actioned even where it is not specifically described elsewhere in this AUP.
1. Keep it legal: Do not use the Services to do anything unlawful, or to help anyone else do so.
2. Keep it clean: Do not create or publish sexual, exploitative, hateful, or gratuitously violent content, and never anything involving minors.
3. Keep it respectful: Treat other players, creators, and our staff as you would want to be treated. Harassment, abuse, and discrimination have no place here.
4. Keep it fair: Do not cheat, automate, exploit, or manipulate the platform or its metrics to gain an advantage over other creators or players.
5. Keep it honest: Do not deceive people about who you are, what your content is, or what you are asking them to do.
III. Prohibited Content and Conduct
You must not use the Services to create, generate, request, upload, publish, share, transmit, link to, or solicit any of the following, in any form (text, image, audio, video, code, or playable game), regardless of whether the subject is real, fictional, stylized, or AI-generated, and regardless of whether the content is ever published:
1. Sexual and Pornographic Content: Pornographic, sexually explicit, or sexually exploitative content, including depictions of sexual acts, sexualized nudity, and content whose primary purpose is sexual arousal. This prohibition applies in full even where the persons or characters depicted are consenting adults, and even where the depiction is stylized, cartoon, or pixel art.
2. Sexual Violence and Non-Consensual Intimate Content: Content depicting, promoting, or trivializing rape, sexual assault, or sexual coercion, and any intimate or sexualized content created, published, or shared without the consent of the person depicted, including synthetic or AI-generated intimate imagery (“NCIC”).
3. Content Involving Minors: Any content that sexualizes, exploits, or endangers a minor. This is addressed in full in Section V (Protecting Minors) and is enforced with zero tolerance.
4. Hate and Discrimination: Hate speech, slurs, dehumanizing content, or content that attacks, degrades, excludes, or promotes violence or hatred against a person or group on the basis of race, ethnicity, national origin, immigration status, religion, caste, sex, gender identity, sexual orientation, disability, serious disease, age, or any other protected characteristic; the display or promotion of symbols or insignia of hate or extremist organizations; and the denial, distortion, or glorification of genocide or other mass atrocities.
5. Violent Extremism and Terrorism: Content that promotes, glorifies, celebrates, or provides support for terrorism, violent extremism, or the individuals or organizations that carry it out, including recruitment, instruction, fundraising, or the reproduction of manifestos or attack footage.
6. Threats, Harassment, and Defamation: Threatening, intimidating, stalking, bullying, or sexually harassing any person; incitement of violence against any person or group; coordinated or targeted harassment campaigns; and defamatory statements about any person or entity.
7. Realistic and Gratuitous Violence: Realistic depictions of real-world violence, torture, cruelty to people or animals, or graphic gore presented for shock value; and re-creations of real violent crimes, atrocities, or tragedies in a manner that mocks, glorifies, endorses, or targets identifiable real victims or their families.
8. Self-Harm and Eating Disorders: Content that promotes, encourages, normalizes, provides instruction for, or provides assistance with suicide, self-harm, or disordered eating.
9. Weapons and Dangerous Materials: Instructions for, or assistance with, the design, manufacture, acquisition, modification, or deployment of weapons, explosives, or chemical, biological, radiological, or nuclear materials.
10. Illegal Goods and Services: The promotion, sale, purchase, or facilitation of illegal goods or services, including illegal drugs and controlled substances, stolen goods or data, counterfeit items, human trafficking, and unlicensed regulated products.
11. Gambling: Real-money gambling, betting, wagering, or lotteries, and any mechanic that offers, simulates, or facilitates the exchange of in-game outcomes, items, or credits for real-world money or value.
12. Fraud, Scams, and Deception: Scams, phishing, social engineering, pyramid or matrix schemes, fake giveaways or promotions, deceptive or malicious links, chain messages, and spam of any kind.
13. Impersonation and False Affiliation: Impersonating any individual, entity, or organization, including MakePlay, Makeplay AI, Inc., our staff, or our moderators; and falsely stating or implying affiliation with, sponsorship by, or endorsement from any person or organization.
14. Political Manipulation: Content or activity intended to interfere with an election or referendum, including voter suppression, voter misdirection, or the impersonation of candidates or officials; coordinated political influence operations or state-sponsored propaganda; and targeted political campaigning, lobbying, or voter-mobilization activity conducted through the Services.
15. Harmful Misinformation: Health, safety, or crisis-related misinformation that is likely to result in physical harm, and content that impersonates official emergency, public health, or government communications.
16. Circumvention of Safety Measures: Any attempt to bypass, disable, degrade, probe, or defeat any content moderation, safety, filtering, age-assurance, rate-limiting, or enforcement measure we implement, including through prompt manipulation, obfuscated or encoded instructions, coded or euphemistic language, chained or indirect requests, or “jailbreak” techniques, whether or not the attempt succeeds.
IV. Restricted Content
Some content is not prohibited outright but is not suitable for general distribution on MakePlay. Restricted Content may be created for your own private use, but must not be published to the arcade or otherwise shared with or made available to other users through the Services. If you publish Restricted Content, we may unpublish, remove, hide, or de-list it, exclude it from recommendation, discovery, trending, and rankings, and apply the measures in Section IX where the conduct is repeated, deliberate, or aggravated. Restricted Content includes:
1. Suggestive and Adult-Oriented Content: Sexually suggestive but non-explicit content, including revealing or fetishized costuming, provocative posing or camera framing, and characters or scenarios framed primarily around sexual appeal.
2. Intense Violence and Horror: Strong, sustained, or realistic violence, gore, body horror, or psychological horror that would be inappropriate for a general audience.
3. Mature Themes: Substance use, crime, or other adult subject matter presented in a serious or explicit manner. Content that promotes, glorifies, or instructs in these activities is prohibited outright under Section III.
4. Sensitive Historical, Religious, and Political Subject Matter: Treatments of real conflicts, disasters, tragedies, religious figures or practices, or contested political events that are handled without malice but are liable to cause serious offense.
5. Strong Language and Crude Content: Pervasive profanity, vulgarity, or crude humor, particularly in publicly visible titles, descriptions, tags, thumbnails, names, or profiles.
6. Anything We Designate: Any other content that we reasonably determine to be unsuitable for a general audience or for public distribution on the Services.
Where content falls within both this Section IV and Section III, Section III applies and the content is prohibited entirely.
V. Protecting Minors
Minors must be afforded special protection. We enforce this Section with zero tolerance, and violations will result in immediate and permanent termination.
1. Minimum Age and Parental Consent: You must be at least 13 years old (or the higher minimum age required in your jurisdiction) to use the Services. If you are under 18, you may use the Services only with the consent and supervision of a parent or legal guardian, as set out in our Consumer Terms of Service. You must not misrepresent your age, help any person misrepresent their age, or assist a minor in circumventing an age requirement or age-assurance measure.
2. Child Sexual Abuse Material (CSAM): The generation, request, upload, possession, storage, distribution, linking, or facilitation of any child sexual abuse material is absolutely prohibited, regardless of whether the content is real, fictional, stylized, cartoon, pixel art, or AI-generated.
3. Sexualization of Minors: Any content that sexualizes, eroticizes, or presents in a sexualized manner a minor, or a character who appears to be a minor, is prohibited whether or not it is sexually explicit. This includes sexualized costuming, posing, framing, dialogue, or narrative involving such characters.
4. Grooming and Predatory Behavior: Engaging in any behavior intended to lure, groom, sexualize, or exploit a minor, including making romantic or sexual advances toward a minor, soliciting sexual or intimate content from a minor, requesting a minor’s personal contact information, and attempting to move communications with a minor to another platform or to an in-person meeting.
5. Exposure of Minors to Inappropriate Content: Knowingly directing, sending, or showing Prohibited Content or Restricted Content to a user you know or reasonably believe to be a minor.
6. Exploitation of Minors: Using, directing, or encouraging a minor to create prohibited content, or otherwise exploiting a minor for sexual, financial, or other benefit.
7. Reporting and Cooperation: We report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) and/or other competent authorities as required by law, may preserve related records and account information for that purpose, and will cooperate with law enforcement investigations.
8. Parent and Guardian Requests: A parent or legal guardian may contact us at support@makeplay.ai to report a concern, request the removal of a minor’s account or content, or ask questions about our protections for minors.
VI. Respecting the Rights of Others
1. Intellectual Property: Do not create, upload, publish, remix, or distribute content that infringes the copyrights, trademarks, patents, trade secrets, or other proprietary rights of any person. Do not upload material you do not own or otherwise have the right to use, and do not imitate or trade on another party’s game, brand, characters, or assets in a way likely to confuse users as to source, sponsorship, or affiliation.
2. AI Output and Inadvertent Similarity: Content generated through the Services is produced automatically and may unintentionally resemble existing works. You are responsible for reviewing anything you publish or distribute and for ensuring that you hold the rights necessary to do so.
3. Likeness, Name, and Voice: Do not generate, publish, or distribute the likeness, name, persona, or voice of any real person without that person’s consent, including deepfakes and synthetic voice, and do not do so in a manner that falsely suggests endorsement or affiliation. Do not upload photographs, video, or audio recordings of another person to any generation feature without that person’s consent, and never upload images of a minor for the purpose of generating a character, likeness, or asset.
4. Biometric and Identification Uses: Do not use the Services to identify, verify, track, profile, or authenticate any individual, or to create, enrich, or contribute to any facial, voice, or other biometric database. The Services are not intended for, and must not be used for, biometric identification of any kind.
5. Privacy and Doxxing: Do not collect, publish, or distribute another person’s private or sensitive information without authorization, including home or workplace address, phone number, email address, government identification, financial or payment information, medical information, private communications, or precise location.
6. Copyright Complaints: If you believe content on the Services infringes your copyright, you may submit a notice by email to support@makeplay.ai, containing the information required under the U.S. Digital Millennium Copyright Act. We will respond to valid notices, will accept counter-notifications, and will terminate the accounts of repeat infringers in appropriate circumstances.
VII. Community and Social Conduct
This Section applies to every interaction you have with another user or with our personnel through the Services, including comments, reviews, ratings, and feedback left on games, support tickets, and — upon their introduction — chat, direct messages, profiles, parties, groups, and any other social, multiplayer, or networked feature. Where such a feature is not yet available, this Section applies from the date it becomes available to you.
1. Treat People Decently: Do not abuse, insult, demean, provoke, troll, bait, or flame other users, and do not target anyone on the basis of nationality, region, ethnicity, race, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic.
2. No Harassment Campaigns: Do not organize, join, or encourage pile-ons, brigading, doxxing, or coordinated campaigns against any user, creator, or their content.
3. No Spam or Unsolicited Promotion: Do not send repetitive, flooding, off-topic, bulk, or automated messages, and do not use the Services for advertising, recruitment, or promotional messaging.
4. No Off-Platform Diversion: Do not use the Services to direct users to external websites, servers, or platforms for any purpose that violates this AUP, including any solicitation described in Section VIII.7.
5. Adults and Minors: If you are an adult, do not initiate private contact with, seek personal information from, request images from, or attempt to move to another platform any user you know or reasonably believe to be a minor. Never arrange or attempt to arrange an in-person meeting with a minor.
6. No Dating or Sexual Solicitation: Do not use the Services for dating, romantic solicitation, sexual solicitation, or the exchange of intimate content, with any user.
7. Report Responsibly: Do not submit false, malicious, duplicative, or automated reports, and do not abuse our reporting, moderation, or appeals tools.
8. Respect Our Personnel: Do not abuse, threaten, harass, or attempt to intimidate MakePlay employees, contractors, or moderators, including in support and appeals channels.
9. Names, Avatars, and Profiles: Usernames, display names, creator names, avatars, banners, and profile text are subject to this AUP in full. We may reset, rename, hide, or reclaim any name or profile element that violates it, or that impersonates or is confusingly similar to another user, MakePlay, or our staff.
VIII. Platform Integrity and Security
1. No Manipulation of Platform Metrics: Do not use bots, scripts, macros, automation tools, emulator farms, click farms, or multiple, coordinated, or artificial accounts to inflate or distort plays, views, ratings, followers, leaderboard positions, or any other metric, or to manipulate discovery, trending, recommendation, or rankings.
2. No Manipulation of Feedback: Do not post, solicit, exchange, or incentivize fake or misleading reviews, ratings, or comments, and do not organize or participate in campaigns to mass-downrank or mass-report another creator or their games.
3. No Exploitation of Bugs: Do not exploit, or publish instructions for exploiting, any bug, glitch, defect, or unintended behavior in the Services for advantage. If you discover one, report it to us at support@makeplay.ai rather than exploiting or publicizing it.
4. No Unauthorized Access or Attack: Do not access or attempt to access any account, system, network, or data you are not authorized to access; do not probe, scan, or test the vulnerability of the Services except under a program we have authorized in writing; and do not conduct denial-of-service, flooding, or other attacks against the Services, our users, or any third party.
5. No Malicious or Harmful Code: Do not create, generate, publish, or distribute any game, asset, script, or other content that contains or delivers malware, viruses, trojans, worms, keyloggers, ransomware, spyware, cryptocurrency miners, drive-by downloads, unauthorized redirects, hidden or deceptive scripts, credential-harvesting or phishing interfaces, or any code that collects data from other users without their knowledge and consent, or that consumes another user’s device, storage, or network resources beyond what the content reasonably requires to function.
6. No Deceptive Interfaces: Do not create or publish interfaces that imitate MakePlay system messages, moderation notices, security or account warnings, login screens, or payment or purchase flows, or that otherwise mislead users about what they are interacting with, what they are agreeing to, or what information they are providing.
7. No Off-Platform Solicitation or Payment: You must not use the Services to solicit, collect, process, or direct any user toward any payment, contribution, or financial transaction outside the Services. This includes, without limitation: payment links, buttons, checkout flows, QR codes, cryptocurrency or wallet addresses, and bank or payment-application details; requests or links for donations, tips, subscriptions, memberships, crowdfunding, patronage, or “supporter” status on any external service; the sale, offer, advertisement, or brokering of any goods, services, currencies, items, accounts, or access, whether your own or a third party’s; paywalls or “premium”, “unlock”, “full version”, or “early access” tiers offered off-platform; affiliate, referral, sponsorship, or advertising links and any other arrangement under which you receive compensation; and any attempt to move a user to another platform, service, or channel in order to complete a transaction. This restriction applies to your games and all content within them, your account name and profile, your game titles, descriptions and tags, and any message or communication you send through the Services.
8. Account Integrity: You are responsible for all activity under your account and for keeping your credentials secure. Do not sell, buy, rent, lend, transfer, or share an account or credentials; do not access or use another person’s account; do not operate additional or coordinated accounts to evade a suspension, ban, restriction, or other enforcement measure, or to assist another person in doing so.
9. No Unauthorized Extraction or Reverse Engineering: Do not scrape, crawl, harvest, or systematically collect content or data from the Services; do not use the Services or their outputs to train, fine-tune, or develop any competing model, product, or service; and do not reverse engineer, decompile, disassemble, or attempt to derive the source code, models, weights, or system prompts underlying the Services, except to the extent this restriction is prohibited by applicable law.
10. No Abuse of Capacity: Do not circumvent or attempt to circumvent rate limits, quotas, generation limits, or other usage restrictions, and do not resell, sublicense, or provide unauthorized third-party access to the Services.
IX. Enforcement, Reporting, and Appeals
1. Our Approach: We may take any action we consider appropriate where we determine that a user has violated this AUP, our Consumer Terms of Service, or applicable law, or where a user’s activity may otherwise pose a risk of harm or liability to us, our users, or any third party. In deciding what action to take, we may consider the severity of the conduct, the user’s intent, the actual or potential harm to others, whether the conduct was repeated or coordinated, the user’s history, and our legal and safety obligations. We are not obliged to take any particular action, or to take action in any particular order.
2. Measures We May Take: Depending on the circumstances, we may take one or more of the following measures, in any order and in any combination, with or without prior notice:
- issuing a warning;
- removing, editing, hiding, or restricting access to content;
- unpublishing a game, or removing or excluding it from the arcade, recommendation, discovery, trending, search, or rankings;
- limiting or disabling features, including generation, publishing, remixing, commenting, messaging, and social features;
- restricting, resetting, or reclaiming a username, display name, avatar, or profile content;
- temporarily suspending the account;
- permanently terminating the account;
- applying any of the above to other accounts we reasonably associate with you, including by device, network, browser, or contact information;
- declining to provide the Services to you in the future; and
- preserving records and reporting the conduct to, and cooperating with, law enforcement or other competent authorities.
3. Immediate Termination for the Most Serious Violations: Where we detect, or receive a credible report of, conduct involving child sexual abuse material or the sexualization of minors, grooming, non-consensual intimate content, pornographic or sexually explicit content, credible threats of violence, terrorism or violent extremism, or the distribution of malicious code to other users, we will immediately suspend or permanently terminate the account without prior notice, and may preserve related records and report the conduct to competent authorities as required by law.
4. Notice: Where reasonably practicable, and where not prohibited by law or inconsistent with our safety obligations or the prevention of further harm, we will notify you of enforcement action and the general reason for it. Where advance notice cannot be given, we will provide notice promptly afterwards where appropriate.
5. Reporting a Violation: You can report suspected violations using the in-product reporting tools where available, or by contacting us at support@makeplay.ai. Please include enough detail for us to locate and assess the content or conduct. We review reports at our discretion and may not be able to tell you the outcome of a report you submit.
6. Appeals: If you believe an enforcement action was taken in error, you may appeal by contacting us at support@makeplay.ai within 30 days of the action, explaining the basis for your appeal. You may submit one appeal per enforcement action unless we permit otherwise. Submitting an appeal does not entitle you to reinstatement, to the restoration of removed content, or to continued access to the Services while the appeal is under review. Our decision on appeal is final, except where mandatory law provides otherwise.
7. Consequences of Termination: If your account is suspended or terminated, you may permanently lose access to your account, your content, and any progress, entitlements, status, or benefits associated with it. We are not obliged to retain, return, export, or provide copies of any content associated with a suspended or terminated account, and no refund or compensation will be provided, except where required by applicable law.
8. Cumulative Rights: Enforcement under this AUP is in addition to, and does not limit, our rights and remedies under the Consumer Terms of Service, any other applicable agreement, or at law.
X. Our Role, Disclaimers, and General Terms
1. No Obligation to Monitor: We have no obligation to review, monitor, filter, screen, or moderate any content, prompt, output, communication, or conduct on the Services, and we do not pre-screen all content. We may do so at our sole discretion, and our doing so at any time does not create any obligation to do so at any other time.
2. Moderation Is Imperfect: Our safety and moderation systems combine automated tools and human review and are provided on an “as is” basis. They may result in content being removed, restricted, or allowed in error, or in an account being actioned in error. Your remedy in such a case is the appeals process described in Section IX.
3. We Do Not Endorse User Content: Games, assets, comments, profiles, and other content on the Services are created by users, not by us. We do not verify, endorse, adopt, guarantee, or assume responsibility for such content, and it does not represent our views.
4. AI-Generated Output: Output produced through the Services is generated automatically and may be inaccurate, incomplete, unexpected, offensive, or similar to existing works. Output does not represent our views. You are solely responsible for reviewing output and for how you use, publish, and distribute it.
5. Interactions with Other Users: You are solely responsible for your interactions with other users. We do not screen users, do not control their conduct, are not a party to those interactions, and are not responsible for them.
6. Third-Party Platforms: Official MakePlay communities hosted on third-party platforms, including Discord and Reddit, are also governed by those platforms’ own terms and policies. We are not responsible for those platforms, their availability, or their moderation.
7. No Third-Party Beneficiaries: This AUP does not create, and is not intended to create, any right, claim, or remedy in favor of any user or third party against us, including any right or claim arising from our decision to take, or not to take, any action in respect of another user or their content.
8. No Waiver: Our failure or delay in enforcing any provision of this AUP does not waive that provision or our right to enforce it, or any other provision, at any later time.
9. Your Responsibility and Indemnity: You are responsible for all activity conducted under your account and for all content you submit, generate, publish, or distribute, including its lawfulness and its compliance with this AUP. The indemnification provisions of the Consumer Terms of Service apply to any claim arising from your breach of this AUP.
10. Limitation of Liability: To the maximum extent permitted by applicable law, we are not liable for any loss or damage arising out of or relating to our enforcement or non-enforcement of this AUP, including any loss of content, progress, access, data, reputation, audience, or opportunity, or any harm caused by another user or by user content. This is in addition to, and subject to, the disclaimers and limitations of liability set out in the Consumer Terms of Service.
11. General Reservation of Rights: We may take any of the measures described in Section IX where we reasonably determine that your conduct: violates the spirit or intent of this AUP, even if it is not expressly described here; constitutes an attempt to circumvent this AUP or our enforcement of it; assists, encourages, solicits, instructs, or enables another person to violate this AUP; violates applicable law or the Consumer Terms of Service; or otherwise presents a risk of harm or liability to us, our users, or any third party. The examples given throughout this AUP are illustrative and are not an exhaustive list of prohibited conduct.
12. Changes to This AUP: We may update this AUP at any time to reflect changes to the Services, our community, or applicable law. Where changes are material, we will make reasonable efforts to notify you, for example through the Services or by email. The “Last updated” date at the top of this AUP indicates when it was last revised. Your continued use of the Services after a revision takes effect constitutes your acceptance of it.
13. Severability: If any provision of this AUP is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14. Availability and Local Law: We may restrict, modify, or discontinue the availability of the Services or of particular features in any jurisdiction, and may apply additional or different rules where necessary to comply with applicable law.
15. Governing Law and Disputes: This AUP, and any dispute, claim, or controversy arising out of or relating to it, is governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, and is subject to the dispute resolution procedures (including informal resolution, binding arbitration, and the class action and jury trial waiver) set out in Section 12 of our Consumer Terms of Service. If you use the Services as a consumer, nothing in this AUP deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and those laws prevail to the extent of any conflict with this AUP.
16. Language: The English-language version of this AUP is the authoritative version. Any translation is provided for convenience only, and in the event of any inconsistency the English version prevails.
